General terms and conditions of business of the company

I Basic provisions
Respecting the basic principles of contract law, good business practices, in accordance with Article 142 of the Law on Obligations, the Director of the Company prescribes the General Terms and Conditions of Business of Skipper travel doo Belgrade, registration number 21058114.
The General Terms and Conditions contain:
– the method of providing transportation services,
– the rights and obligations of the service provider / transporter, passenger / service user,
– the method of payment for the services provided,
– the quality of the service provided and the resolution of complaints.
When performing the obligations established by the general terms and conditions of business, the contracting parties are obliged to behave with the care of a good expert / good host – that is, with increased care, guided by the rules of the profession and good business practices.
The General Terms and Conditions of the Transporter (hereinafter: General Terms and Conditions) are an integral part of all transport contracts that the Company Skipper travel doo Belgrade (hereinafter: Transporter) concludes with users of its services (hereinafter: User of the services).
The General Terms and Conditions are published on the Company’s website, and the Transporter shall make them available to the other contracting party in another suitable manner.
Based on the General Terms and Conditions, the Transporter acts as a service provider within the scope of its regular business activities.
Based on the General Terms and Conditions, the Service User is considered to be any legal entity/individual who contracts the use of the carrier’s services/who uses the services of the Transporter.
By using the Carrier’s services, the Service User acknowledges that he/she is familiar with the content of the General Terms and Conditions and accepts that they apply to him/her without restriction.
Method of contracting the Transportation service
Contracting services is based on individual inquiries from the Service User, which can be given by phone, e-mail or any other form of direct communication.
The Transporter is obliged to respond to the inquiry immediately, and no later than within 24 hours, and to confirm in writing, by SMS, e-mail.
A service that is not confirmed in this way is not binding on the Transporter.
The Transporter is not obliged to verify data, documentation or information received from the Service User.
The Service User is obliged to match the information on which the task is based with their needs and task specifications.
II Types of services
- a) Daily / multi-day vehicle hire with driver in Belgrade
Every daily or multi-day rental of a vehicle with a driver in Belgrade is agreed in writing by sending a request/inquiry by the client to the carrier, after which the carrier delivers its offer no later than 24 hours from the date of the request, and the client accepts or rejects it in writing no later than 24 hours from the date of receipt of the offer from the carrier.
Rental of a vehicle with a driver can be:
- up to 3 hours (for airport transfers only) with 25 kilometers covered included with the possibility of paying for additional kilometers.
– in the event of a flight delay of more than an hour, the carrier reserves the right to cancel the contracted transfer without charging the contracted airport transfer;
– in the event of a flight cancellation a few hours on the day of the contracted airport transfer, the carrier reserves the right to charge 100% of the contracted airport transfer price;
– in the event of a passenger not showing up at the arrival airport from the contracted flight, the carrier reserves the right to charge 100% of the contracted airport transfer price.
- up to 4 hours (minimum daily engagement) with 50 kilometers covered included with the possibility of paying an additional hour and additional kilometer (according to the carrier’s current price list);
- up to 6 hours with 100 kilometers covered included (HALF CAR DAY) with the possibility of paying an additional hour and additional kilometer (according to the carrier’s current price list);
- up to 8 hours with 150 kilometers covered with the possibility of paying an additional hour and additional kilometer (according to the carrier’s current price list);
- up to 10 hours with 200 kilometers covered (FULL CAR DAY) with the possibility of paying an additional hour and additional kilometer (according to the carrier’s current price list);
- for vehicles equipped with a tachograph device, additional hours over 13 hours of engagement are agreed under special conditions with the carrier (additional costs for hiring another driver).
- b) Multi-day hire of a vehicle with a driver outside Belgrade
- the maximum daily hire of a vehicle with a driver is 10 hours and includes 200 kilometers traveled according to the valid price list or offer of the carrier;
- the end of the working day and hire of a vehicle with a driver is until 19:00;
- in the case of the start of the daily hire before 09:00 am, an additional hour is calculated after the expiration of the 10th hour of the daily hire according to the valid price list of the carrier;
- in the case of the start of the daily hire after 09:00 am, the contracted daily hire will end no later than 19:00 with the possibility of extension for an additional fee according to the valid price list of the carrier;
- additional hour over the agreed 10 hours is charged additionally according to the price list that you can download from the website;
- additional kilometer over the agreed 200 kilometers is charged additionally according to the price list that you can download from the website
Driver Accommodation
The driver may be accommodated:
– in the hotel where the Service User / passengers from the vehicle are accommodated, in a separate room, with bed and breakfast service and adequate parking for the vehicle. In the case of a parking fee, the entire cost is borne by the Service User.
– in a hotel up to 5 km away from the hotel where the Service User / passengers from the vehicle are accommodated, with bed and breakfast service and adequate parking for the vehicle. In the case of a parking fee, the entire cost is borne by the Service User.
– Lunch and dinner for the driver are paid to the driver by the carrier (employer) in the amount of €20 for both meals in one day, and the carrier increases the price of the engagement to the client by that amount
– in the event that the carrier organizes accommodation and breakfast for the driver, as well as overnight parking, the price per day of hiring a vehicle with a driver is increased by €100 including VAT.
– The group companion is obliged to resolve the issue of transportation at his own expense if he is not in the accommodation where the passengers are or where the driver is.
IV Service price and payment terms
The price of hiring a vehicle with a driver includes:
– vehicle,
– driver,
– fuel,
– tolls (all countries during the hiring) / vignettes (all countries during the hiring),
– VAT (all countries during the hiring).
The price does not include:
– parking lots (day and night),
– checkpoints,
– bridge tolls,
– passage through tunnels,
– transportation by ferry, boat, raft, etc.,
– as well as all other costs not listed in the costs included in the hiring price.
The price is formed according to the inquiry, itinerary or request of the Service User that has been previously submitted to the carrier in writing, which describes in detail the type of service required from the carrier with the exact times and places that will be visited during the hiring.
The Transporter reserves the right to increase the price of the service if, during the engagement, the Service User changes the route, planned times and other details specified in the original request.
Vehicle reservations are made by accepting the carrier’s offer in writing.
Payment of 100% of the advance payment for hiring a vehicle with a driver at the time of booking is necessary only in special cases, depending on the Carrier’s assessment.
The percentage of compensation that the client will pay to the carrier in the event of cancellation of the contracted engagement, and upon prior written confirmation of acceptance of the engagement (without previously paid 100% advance payment) is calculated as follows:
– cancellation 30 days before engagement: 10% of the total price of the vehicle with driver including VAT;
– cancellation 20 days before engagement: 20% of the total price of the vehicle with driver including VAT;
– cancellation 10 days before engagement: 30% of the total price of the vehicle with driver including VAT;
– cancellation 5 days before engagement: 40% of the total price of the vehicle with driver including VAT;
– cancellation 3 days before the hire: 60% of the total price of the vehicle with driver including VAT;
– cancellation 1 day before the hire: 80% of the total price of the vehicle with driver including VAT;
– cancellation on the day of the hire: 100% of the total price of the vehicle with driver including VAT.
Service Restrictions
The Transporter reserves the right to refuse to provide/interrupt the service if there is a risk to passengers, employees or property of the Transporter.
In extraordinary circumstances, changes in the traffic situation, as well as in cases of natural disasters, the Carrier reserves the right to significantly change the time, route, vehicle or any element of the service, when this is in the best interest of passengers, employees and to protect the property of the Transporter.
The Carrier may refuse to transport persons whose behavior or condition significantly violates any aspect of traffic safety, as well as persons who pose a risk of harmful behavior, even if the previously agreed service has been confirmed.
Children under 6 years of age cannot use the Carrier’s services independently without the supervision of a parent / guardian / escort.
The Carrier is obliged to provide the means and adequate service from the aspect of the safety of transporting children, but the behavior of children in accordance with the instructions of the Carrier’s employees is obliged to be ensured by the parent / guardian, or escort.
Obligations of the service user
The service user / Passenger is obliged to obtain the necessary travel documents and visas and to comply with the laws, regulations, conditions and rules of travel of the countries to/from which he/she is traveling and through which he/she is transiting.
The Carrier is not responsible for the consequences that the Service User / Passenger suffers if he/she fails to obtain the appropriate documents or visas and if he/she fails to comply with the aforementioned laws, regulations, decrees, conditions, rules and instructions.
The Service User / Passengers are obliged to:
– use the vehicle with due care, and avoid any behavior that may in any way jeopardize the safety or adequate implementation of the service;
– refrain from any actions that may interfere with the work of the driver / Carrier;
– do not smoke in vehicles, do not drink alcohol, behave inappropriately and in a manner that may endanger the lives and safety of other road users;
– comply with all instructions of the Carrier on all issues related to the use of the service and the vehicle.
If the Service User / Passenger does not comply with the obligations established by the General Terms and Conditions, and if he behaves in a manner that disrupts the comfort or peace of other passengers or crew or that may result in damage or injury to them, the Carrier has the right to take measures it deems necessary to stop such behavior, including disabling movement.
The Carrier has the right to require the Passenger to disembark from the vehicle and refuse further transportation at any point, and to take legal measures against the Passenger for violations committed while in the vehicle.
Baggage
The passenger has the right to free carriage of a certain amount of baggage, in accordance with the conditions and restrictions that may be obtained from the Carrier.
The Carrier reserves the right to refuse the carriage of baggage if there is not enough space for its adequate and safe storage in the vehicle, if there is a suspicion that the baggage contains items that may endanger the safety of participation in traffic (self-igniting and explosive devices), are illegal goods (drugs, antiques, materials prohibited by law), baggage whose weight exceeds the maximum permissible load of the vehicle, baggage that cannot be properly and safely arranged in the space provided for this due to its nature and size.
Firearms and ammunition, except for those used for hunting and sports, may not be transported as Baggage. Hunting and sports weapons and ammunition may be accepted as registered baggage. Weapons must be unloaded, locked and packed.
Luggage and other valuables cannot be left in the vehicle, i.e. the Carrier does not bear any responsibility for them even in cases where the service user leaves the vehicle for a short period of time. This provision also applies to any confidential documentation, data storage devices and part of hand luggage whose disappearance would cause damage to the Service User / Passenger.
The Carrier is obliged to keep forgotten luggage or other personal belongings of the Service User / Passenger for 30 days after the end of the service.
The Carrier is obliged to contact the Service User via the contact information provided to inform him about the forgotten luggage.
After the expiration of the storage period, the Carrier is not obliged to take further care of the left luggage.
Animal transportation
The Carrier’s vehicles are prohibited from transporting rare species of animals, animals protected by law, animals whose transportation requires special conditions, means or veterinary care.
The Service User is obliged to inform the Carrier in detail about all important aspects of such transportation. The User is obliged to provide all information in writing to the Carrier when booking the vehicle.
The Carrier’s vehicles allow the transportation of domestic, domesticated animals, accustomed to being close to people and staying indoors for a long time, under the following conditions:
- The Service User / Passenger is obliged to ensure that the animal is properly housed in a cage and has valid health certificates, vaccination certificates, entry permits and other documents in accordance with the requirements of the country of entry or transit. Otherwise, the animals will not be accepted for carriage, i.e. the Service User / Passenger is obliged to compensate the Carrier for all penalties, costs, losses or obligations that the Carrier may incur as a result. In the event that the provision of the service is interrupted for this reason and the Service User returns to the original destination, the Carrier reserves the right to change the price of the service and additional charges resulting from the change in the service;
- The Service User / Passenger is responsible for the behavior of the animal and is liable for any damage caused by the animal;
- The animal must not in any way endanger the work of the Carrier or other passengers. The Carrier reserves the right to suspend the service in cases where the safety of transportation is jeopardized by the behavior of the animal. The Carrier reserves the right to change the price of the service and additional charges resulting from the change in the service.
The Carrier is not responsible for the consequences that the animal causes to third parties during transportation, and does not bear moral or material responsibility for the behavior of the animal, its health condition or injuries that occur during transportation. The Carrier will not be responsible for injury, loss, illness or death of an animal that it has accepted for transportation, unless the aforementioned conditions occurred due to the negligence of the Carrier.
IV Rules of conduct for passengers during the hiring of a vehicle with a driver
Service users / Passengers are obliged to comply with traffic safety rules, otherwise the Carrier is not liable for safety risks.
The Transporter has the right to terminate the provision of the service in the event of major violations of traffic safety by passengers or those that are carried out continuously (standing, moving around the vehicle, sitting on the seat contrary to the rules, etc.)
Service users / Passengers must behave in accordance with generally accepted rules of conduct, otherwise they owe compensation for damages.
Upon completion of the service, the Service User / Passenger is obliged to inspect his luggage, its hygiene and any possible damage.
The Service User / Passenger can file any complaint related to the transportation of luggage at the place of completion of the service. Any subsequent complaint related to material damage to the luggage will not be accepted.
The Service User of the Carrier is obliged to check the passenger compartment in which he was transported, the devices he used and the documents he had with him. The Carrier is not responsible for objects and valuables that the Service User leaves behind in the vehicle.
V Passenger safety and aesthetic preservation of the vehicle
Normal traces of use will not be charged separately to the Service User.
In the event of greater dirtiness of the vehicle than usual, the cleaning costs will be borne by the Service User.
The Service User is liable for any damage caused to the vehicles by him/herself or the Passenger.
VI Quality of the Service Provided and Resolution of Complaints
A complaint about the quality of the service shall be filed immediately upon the observed omission, with proof of the validity of the claims for which the complaint is filed.
The Carrier is obliged to immediately upon receipt of the complaint, examine all the circumstances of the case, and notify the Complainant/Service User of its validity immediately, and at the latest within 1 day of receipt, in more complex cases within 10 days.
In the event of a justified complaint, the Transporter is obliged to resolve it as soon as possible, and if this is not possible, the Service User exercises the right to a reduction in the fee in an amount determined depending on the circumstances of the case.
Insurance
The Transporter provides legally required insurance for its employees, passengers and material assets. In addition to this legally required insurance, it is possible to pay for additional insurance through the Carrier at the special request of the Service User.
Any type of agreement and expansion of the service in this segment is agreed in writing before defining the entire service as one of the elements of the Service User’s request to the Carrier.
VII Other provisions
The General Terms and Conditions are adopted for an unlimited period of validity, and all possible amendments and supplements to them will be made in writing.
An integral part of the General Terms and Conditions is also the valid price list of the Transporter.
The applicable law for the General Terms and Conditions and for all contracts that the Service Users conclude with the Carrier under these General Terms and Conditions is Serbian law.
The contracting parties agree that they will resolve all possible disputes amicably.
If an amicable resolution of the dispute is not possible, the competent court in Belgrade shall have jurisdiction over all disputes arising from contracts concluded under the General Terms and Conditions.
The General Terms and Conditions are drawn up in Serbian and English. In the event of any discrepancy between the language versions, the Serbian version shall prevail.
